1. Acceptance of these Terms

These Terms of Service ("Terms") form a binding agreement between you and Doctor Genio, S.A. de C.V., a company incorporated under the laws of the United Mexican States, with registered address at Francisco Javier Mina 752, Col. Centro, C.P. 64000, Monterrey, Nuevo León, Mexico, and taxpayer registry number (RFC) DGE1309098K4, which provides the service under the trading name "DestinyTara" ("DestinyTara", "we", "us", "our"). By creating an account, accessing, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms, the Privacy Policy, and the Acceptable Use Policy. If you are a consumer resident in Mexico, the Spanish-language version of these Terms governs; versions in other languages are provided as a courtesy translation only.

Clicking the acceptance mechanism during registration constitutes your electronic signature and your express consent to these Terms. Electronic acceptance is governed by the Mexican Código de Comercio, and — where a user's own local law also gives legal effect to electronic signatures (such as the EU eIDAS Regulation or comparable electronic-signature statutes) — those laws confirm, and do not expand, the scope of the Service described in these Terms. The Service is operated from and directed from Monterrey, Nuevo León, Mexico, and is not offered or marketed to users in any jurisdiction excluded under Section 7.

2. Service description

DestinyTara is a SaaS platform that uses AI and algorithmic analysis of classical Chinese mathematical frameworks (Qi Men Dun Jia, BaZi, and Zi Wei Dou Shu) to generate reflections on timing, personal context, and cultural symbolism. The Service is a cultural-analytics, personal-reflection, and digital-entertainment tool. It does not diagnose, prescribe, predict outcomes, or recommend specific decisions.

3. Eligibility — 18+ only

You must be at least 18 years old to use DestinyTara. The Service is not intended for, marketed to, or designed for minors. Users under the age of 18 are prohibited from creating an account, submitting birth data, or otherwise using the Service. If we discover that a user is under 18, we will terminate the account and delete associated data.

4. Account security

The Service uses passwordless One-Time Password (OTP) authentication via email. You are responsible for maintaining the security of your email account and for all activity under your account.

5. AI-generated content disclosure (EU AI Act Art. 50)

All analytical content you receive on DestinyTara is generated by an AI system applied to classical Chinese mathematical calculations. You are being informed that you are interacting with an artificial-intelligence system. The AI has no consciousness, sentience, intuition, or independent judgment, and its outputs must not be relied on as factual statements about the future, about any person, or about the physical world.

6. Prohibited uses

You agree that you will not use the Service:

• to make or influence medical, psychological, psychiatric, legal, or financial decisions, including decisions about medication, treatment, diagnosis, litigation, investing, or credit;
• to produce readings, charts, or interpretations about identifiable third parties without their informed consent (including partners, former partners, children, family members, coworkers, employees, clients, public figures, or any other named individual);
• to make decisions about another person's health, medication, relationships, finances, or welfare, including decisions affecting minors;
• in any jurisdiction or in any manner prohibited by the law that applies to you. Some jurisdictions regulate or license categories such as divination, psychic, or counseling services. We do not offer the Service in any jurisdiction that would classify it within such a category, and you must not access it from one;
• to harm yourself or others, or to encourage, justify, or plan self-harm, violence, discrimination, or harassment;
• in any regulated professional context (medicine, psychology, psychiatry, therapy, law, financial advice, insurance) as a basis for advice you give to clients, patients, or the public, without your own independent professional judgment and disclosure that the output is AI-generated cultural content.

You are solely responsible for your use of outputs. Additional rules appear in our Acceptable Use Policy.

7. Territorial exclusions

The Service is offered only where it is lawful and only to eligible users. Where a jurisdiction classifies a cultural or reflective tool like this one within a regulated category, we do not offer the Service there. You are not the intended user, and you must not use the Service, if you are located in a jurisdiction that restricts such tools — including, without limitation, much of the European Economic Area and United Kingdom, mainland China, and certain US states and municipalities. We enforce these exclusions by location, and access from an excluded location is not authorized regardless of these Terms.

We do not undertake to list every excluded jurisdiction, and the fact that access is technically possible from a location does not mean the Service is offered there.

By using the Service, you represent that you are not accessing it from a prohibited jurisdiction and that your use does not violate any law applicable to you.

8. Mental-health and crisis notice

DestinyTara is not a crisis, counseling, or mental-health service. If at any time you experience suicidal ideation, thoughts of self-harm, or a mental-health crisis, stop using the Service and contact a local crisis line or emergency services immediately. Example crisis resources:

9. Virtual credit system

Credits are non-monetary, non-transferable, revocable digital access licenses. They have no intrinsic monetary value, are not redeemable for cash, and may not be traded or sold. Once consumed, Credits are non-refundable.

Plan credits vs. purchased credits. Your subscription includes a monthly allotment of plan credits. Plan credits refresh at the start of each billing period and do not roll over — any plan credits you have not used when your plan renews are replaced by that period's new allotment, not added to it. Separately, you may buy credit top-ups à la carte; purchased credits do not expire and are not reset by a renewal. When you spend credits, plan credits are used first and purchased credits last.

10. Subscriptions & billing

Payments are processed through our third-party payment providers (currently Stripe and PayPal). Subscriptions renew automatically at the then-current price until you cancel.

Advance renewal notice. For subscriptions billed through Stripe, we send an advance renewal reminder before each renewal charge, consistent with Mexico's PROFECO renewal-notice expectations. For subscriptions billed through other providers (currently PayPal), your renewal date and amount are shown at checkout and in your account, and your provider issues its own billing receipts; you can view and cancel the subscription at any time from your account or from your provider. Whichever provider you use, you can cancel at any time in one click — no penalties and no retention steps, and cancellation stops all future renewals.

11. Cancellation and refunds

Cancel anytime, in one click. You can cancel your subscription at any time from your account settings, with no penalty and no retention step. When you cancel, your plan remains active until the end of the period you have already paid for, and it does not renew after that.

Statutory consumer rights we honor. Nothing in these Terms limits any refund, withdrawal, or cancellation right you already have under the mandatory consumer law of your own country. In particular:

• Mexico (PROFECO / Ley Federal de Protección al Consumidor): You keep all rights granted by Mexican consumer-protection law, including the right to clear pricing, the right to cancel a recurring subscription, and the advance renewal notice described in Section 10.
• EU / EEA (Consumer Rights Directive): You have a 14-day right of withdrawal on new subscriptions, subject to Section 12.

Digital credits. Because credits unlock digital content immediately on use, credits that have already been consumed are non-refundable, except where a refund is required by the mandatory consumer law that applies to you. Unused subscription time is handled as described above.

12. Withdrawal and cancellation

The Service is not offered to, and is not available in, the European Union, the EEA, the United Kingdom, Switzerland, China, or Brazil; access from these regions is blocked. Consequently, EU/UK statutory withdrawal rights (including Directive 2011/83/EU) do not apply to this Service. Where a right of withdrawal or cancellation nonetheless applies under the law governing your purchase, you may exercise it via our withdrawal page; any charge for service already provided will be prorated, and unused subscription time is handled as described in Section 11.

13. No warranty — disclaimer

Results produced by DestinyTara are informational, non-deterministic, and reflective in nature. They are not predictions, diagnoses, prescriptions, or professional recommendations, and they come with no warranty of accuracy, predictive value, outcome, or fitness for any particular decision.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, INCLUDING ALL AI-GENERATED CONTENT, CHARTS, TEXT, AND CALCULATIONS, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. DESTINYTARA DOES NOT WARRANT THAT OUTPUTS WILL BE TRUE, RELIABLE, OR SUITABLE FOR ANY DECISION, AND YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SERVICE.

14. Limitation of liability

To the maximum extent permitted by applicable law, DestinyTara, its affiliates, officers, employees, agents, and suppliers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages.

DestinyTara's total aggregate liability for any and all claims arising out of or relating to the Service in any twelve (12) month period is capped at the amount you actually paid to DestinyTara for the Service during the twelve (12) months preceding the event giving rise to the claim. Where that amount is zero, the cap is US$100.

15. Governing law and dispute resolution

15.1. Governing law. These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of the United Mexican States, without regard to conflict-of-law rules.

15.2. Informal resolution first. Before commencing any proceeding, you agree to first contact the Company at legal@destinytara.com and attempt to resolve the dispute in good faith. If it is not resolved within thirty (30) calendar days of your written notice, either party may bring the matter before the competent courts or authorities.

15.3. Jurisdiction. Except as provided in Section 15.4, the parties submit to the jurisdiction of the competent courts of Monterrey, Nuevo León, Mexico, waiving any other venue that might correspond to them by reason of their present or future domicile. The Service is a Mexico-based offering and is not directed to, established in, or intended to create a place of business in any other country.

15.4. Non-waivable consumer rights. Nothing in these Terms limits, excludes, or modifies any rights that the consumer-protection law of your country of habitual residence grants you on a non-waivable basis. In particular, if you are a consumer in Mexico, you retain in full the right to bring a complaint before the Procuraduría Federal del Consumidor (PROFECO) and to use the conciliation, arbitration, and other dispute-resolution procedures under the Ley Federal de Protección al Consumidor, as well as the right to sue in the courts of your domicile where applicable law so provides. Section 15.3 does not apply to you to the extent it would restrict those rights.

16. Enforcement

We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms or the Acceptable Use Policy, or if continued use creates legal, safety, or security risk. Termination for violation may occur without refund.

17. Entire agreement; order of precedence

These Terms, together with the Privacy Policy and the Acceptable Use Policy, are the entire agreement between you and DestinyTara regarding the Service and supersede any prior or contemporaneous agreements. Where any document referenced here conflicts with these Terms, these Terms as published at destinytara.com/legal/terms control. No summary, marketing page, in-app copy, or support statement modifies these Terms. If any provision is held unenforceable, the remaining provisions stay in full force.
