1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and DestinyTara, a company incorporated in Monterrey, Nuevo Leon, Mexico. By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Your affirmative act of clicking the acceptance mechanism during registration constitutes your electronic signature and express consent under the Mexican Codigo de Comercio, the US E-SIGN Act, and the EU eIDAS Regulation.
2. Service Description
DestinyTara is a SaaS platform providing educational exploration of historical timing systems using AI and algorithmic analysis of Qi Men Dun Jia mathematical frameworks. The Service is classified as Cultural Analytics, Traditional Timing Strategy, and Digital Entertainment — a Cultural Analytics, Traditional Timing Strategy, and Digital Entertainment platform.
3. Eligibility
The Service is intended exclusively for individuals at least 18 years of age with the legal capacity to enter into binding contracts.
4. Account Security
The Service uses passwordless One-Time Password (OTP) authentication via email. No traditional password is created or stored. You are responsible for maintaining the security of your email account.
5. AI Transparency (EU AI Act)
All strategic advice and analytical content is produced by an artificial intelligence system (Qwen 72B via Together AI). This disclosure satisfies Article 52 of the EU AI Act. The AI does not possess consciousness, sentience, or independent judgment.
6. Virtual Credit System
Credits are non-monetary, non-transferable, revocable digital access licenses. They have no intrinsic monetary value, are not redeemable for cash, and may not be traded or sold. Once consumed, Credits are non-refundable.
7. Subscriptions & Billing
Payments are processed through Stripe. Subscriptions renew automatically. In compliance with Mexico's PROFECO, we send renewal notices at least 5 days before each charge. You may cancel anytime with one click — no penalties, no retention tricks.
8. EU Right of Withdrawal
EU/EEA consumers have a 14-day right of withdrawal. This right may be waived upon explicit consent to immediate access to digital content during checkout, per EU Consumer Rights Directive Article 16(m).
9. Limitation of Liability
To the maximum extent permitted by law, DestinyTara's total aggregate liability shall not exceed the lesser of: (a) the total fees paid by you during the six (6) months preceding the event; or (b) one hundred United States Dollars ($100.00 USD).
10. Governing Law
These Terms are governed by the laws of Mexico, with disputes resolved in courts of Monterrey, Nuevo Leon, or through ICC/ICDR arbitration. Class action waiver applies to the maximum extent permitted by applicable law.
